GTA Bylaws — When You Are Required to Use Permeable Pavers

You may not have a choice. Several GTA municipalities now require permeable paving for new or expanded hard surfaces.

Toronto Municipal Code Chapter 681

Requirement: Any new hard surface over 50 square meters (538 sq ft) requires stormwater retention. Retention can be permeable paving, rain garden, underground storage, or green roof.

Exception: Replacing existing hard surface in the same footprint (no expansion) is exempt.

Fine for non-compliance: Up to $25,000.

Applies to: Patios, driveways, walkways, pool decks, and any new impervious surface.

Mississauga Stormwater Management By-law 022-2024

Requirement: Any new hard surface over 30 square meters (323 sq ft) requires permeable paving or on-site retention.

Effective: January 1, 2025.

Applies to: All residential patios, driveways, and walkways.

Vaughan Zoning By-law 001-2025

Requirement: New driveways must have permeable surface for the first 10 feet from the street. Patios over 50 percent of backyard require infiltration trench (permeable pavers qualify).

Oakville and Pickering

Requirement: No municipal-specific hard surface bylaws as of April 2026. Provincial standards only.

Choose traditional interlocking if:

  • Your patio is under 300 sq ft

  • You live in Oakville or Pickering (no permeable bylaws yet)

  • You are on a tight budget (under $7,000 for 400 sq ft)

  • Your yard already slopes away from the house (no drainage issues)

  • You do not mind re-sanding every 2–3 years

Choose permeable pavers if:

  • You live in Toronto or Mississauga and your patio is over 300 sq ft

  • Your yard is flat or slopes toward the house (permeable reduces water pooling)

  • You want the Toronto rebate (up to $3,400 back)

  • You never want to re-sand your patio again

  • You have basement flooding issues (permeable reduces water near foundation)

  • You are environmentally conscious (reduces stormwater runoff)

The one question I ask every homeowner: “Does water ever pool in your yard after heavy rain?” If yes, choose permeable. Traditional interlocking will not solve pooling — it will just sit on top of it. Permeable allows water to drain through, reducing pooling by 80–90 percent.

My personal recommendation for most GTA homeowners: Permeable with a mid-range paver ($28–$32/sq ft before rebate). After Toronto rebate, you pay $21–$25/sq ft — comparable to traditional. You get better drainage, no re-sanding, and compliance with bylaws. The only reason to choose traditional is budget under $7,000 or location outside rebate areas.

Water Runoff Comparison — Real Numbers for GTA Homeowners

A 400 sq ft patio receives thousands of gallons of water each year. Where that water goes matters.

Annual rainfall in Toronto: Approximately 32 inches per year.

Water volume on 400 sq ft patio:

  • 400 sq ft × 32 inches ÷ 12 inches per foot = 1,067 cubic feet of water

FAQ — Permeable vs Traditional Patio in the GTA

Is permeable paver maintenance really that much lower?

Yes. Traditional interlocking requires re-sanding every 2–3 years. Permeable has no sand joints — just open gaps. You vacuum clean the gaps every 2 years (professional service) or hose them out. No weeds, no sand washout, no joint erosion.

Can I convert my existing traditional patio to permeable?

No. Permeable requires a different base (open-graded clear stone, 12–18 inches deep) and different pavers with wider gaps. You cannot convert. You would need to remove the existing patio and install new.

Do permeable pavers work on slopes?

Yes, up to 8 percent slope (1 foot drop per 12 feet horizontal). Steeper slopes require terracing or check dams. Most GTA yards are fine. My team checks slope during the estimate.

Will permeable pavers freeze and heave in winter?

Less than traditional pavers. Permeable bases are deeper (12–18 inches vs 6–8 inches) and use clear stone (no fines that hold water). Water drains through immediately, so there is less water to freeze. Permeable actually performs better in GTA winters than traditional.

Can I use permeable pavers for my driveway?

Yes, but the base must be engineered for vehicle weight (18–24 inches deep). Cost is higher ($30–$45 per sq ft). Toronto and Mississauga require permeable for new driveways over certain sizes. Vaughan requires permeable for the first 10 feet from the street.

How do I clean permeable paver gaps?

DIY: Use a garden hose with a narrow nozzle to blow debris out of gaps. Professional: Vacuum truck with specialized permeable paver cleaning head ($200–$300 for 400 sq ft). Do not use sand or polymeric sand — that defeats the permeability.

Do permeable pavers qualify for any other GTA rebates besides Toronto?

Mississauga has a pilot permeable paver rebate (up to $2,000) starting April 2026. Vaughan follows in September 2026 (up to $2,500 proposed). Oakville and Pickering have no rebates as of April 2026. We update our website as programs launch.

How long do permeable pavers last in GTA climate?

25 to 30 years — same as traditional interlocking. The pavers themselves are similar. The base is deeper and more durable. Permeable patios I installed in 2010 are still performing perfectly.
